Terms of Service

Everest Nova is a product and service of Everest Links Pte Ltd, Singapore. These Terms form a contract between Everest Links Pte Ltd and the organization purchasing or using the service.

The service is for business users aged 18 or older. If you create an account, accept these Terms, or place an order for an organization, you confirm that you have authority to bind that organization.

Everest Nova provides medical device classification support, pathway assessment, documentation review, and dossier preparation only to the extent stated in the confirmed checkout, quote, statement of work, or signed service schedule. A signed written scope controls over general website descriptions.

Unless a separate written appointment expressly says otherwise, Everest Nova does not act as a manufacturer, Singapore registrant, Malaysia Authorized Representative, importer, distributor, conformity assessment body, regulator, legal adviser, or direct regulatory submitter.

Government, regulator, conformity-assessment, testing, translation, licensing, registration, local-representative, tax, and other third-party fees are excluded unless a written quote expressly includes them. Everest Nova does not guarantee registration, approval, acceptance, timing, or commercial outcome.

You must provide accurate account, billing, product, manufacturer, authorization, intended-use, classification, evidence, and prior-approval information; protect account credentials; and promptly report suspected unauthorized access. You remain responsible for verifying the final dossier and for the accuracy, completeness, legality, safety, and regulatory suitability of all client-supplied information.

By supplying material, you confirm that you have all necessary rights, permissions, notices, and lawful authority for Everest Nova and its service providers to use it to perform, secure, and support the service.

Do not upload patient, clinical-trial subject, or other directly identifiable health information. De-identify document contents and file names before upload.

Any class selected by a client or returned by the estimator is preliminary. Everest Nova confirms the working class, scope, and exact professional fee before dossier payment where review is required. New facts can require a revised classification, scope, timeline, or price; additional paid work proceeds only after confirmation.

Everest Nova may use AI-assisted tools to structure project context, screen a file inventory, identify likely gaps, and draft follow-up questions. AI output may be incomplete or incorrect and is not legal advice, a regulator decision, or an approval prediction. Everest Nova personnel review AI-assisted findings and control delivered work; the client must review final materials before submission or other reliance.

The exact currency, professional fee, discounts, credits, and selected paid items are shown before Stripe payment or in a written quote. Unless expressly stated otherwise, prices exclude government charges, bank charges, withholding, sales, service, value-added, goods-and-services, and similar taxes. You are responsible for applicable taxes and may not reduce payment for withholding unless required by law; if withholding is required, you must provide official evidence.

Everest Nova may suspend work for failed, reversed, disputed, or overdue payment. Refund eligibility depends on duplicate or erroneous payment, project stage, work completed, committed third-party costs, and the Refund Policy or applicable written terms.

Each party must protect the other party's non-public commercial, technical, and regulatory information using reasonable care and use it only for the agreed service, except where disclosure is authorized or legally required. Separate signed confidentiality terms control if they conflict with this paragraph.

You retain ownership of client-supplied material. Everest Nova retains its pre-existing methods, templates, prompts, know-how, software, and general improvements. After full payment, you receive a non-exclusive, worldwide right to use the final paid deliverables for your internal business and applicable regulatory submissions. You grant Everest Nova the limited rights needed to perform and support the service. Feedback may be used without identifying you or disclosing confidential information.

You must not bypass access controls, introduce malicious code, impersonate another person, scrape or reverse engineer the service where prohibited, infringe rights, submit unlawful or misleading material, or use the service for sanctions evasion or improper regulatory conduct.

Everest Nova may suspend access or work where reasonably necessary for security, non-payment, suspected unlawful use, material breach, sanctions risk, or protection of confidential information. Either party may terminate an ongoing service for material breach not cured within a reasonable written notice period. Accrued payment obligations and provisions intended to survive termination remain effective.

To the maximum extent permitted by law, the service and preliminary assessments are provided without implied warranties of approval, fitness for a particular regulatory outcome, or uninterrupted availability. Timelines can be affected by client delays, new facts, third-party systems, authority requests, and events beyond reasonable control.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss, or for lost profit, revenue, opportunity, goodwill, or anticipated approval. Everest Nova's aggregate liability arising from an affected service will not exceed the professional fees paid to Everest Nova for that service during the 12 months before the event giving rise to the claim. These limits do not apply to fraud, wilful misconduct, payment obligations, breach of confidentiality or data-protection obligations, or liability that law does not permit a party to exclude or limit.

To the extent permitted by law, the client will defend and indemnify Everest Nova against third-party claims arising from client-supplied material that is unlawful, knowingly false, infringing, or supplied without required rights, or from the client's product manufacture, safety, marketing, distribution, submission, or use outside Everest Nova's agreed service. This does not apply to the extent a claim was caused by Everest Nova's breach, negligence, or wilful misconduct.

Each party will comply with applicable anti-bribery, anti-corruption, sanctions, export-control, and trade laws. You must not ask Everest Nova to make an improper payment, conceal a material fact, or misrepresent a product or regulatory record.

These Terms are governed by Singapore law, without regard to conflict-of-law rules. The parties will first try in good faith to resolve a dispute through written escalation. If unresolved, the Singapore courts have exclusive jurisdiction, subject to any mandatory rights or forum that applicable law does not allow the parties to vary.

Legal notices to Everest Nova must be sent to support@everestnova.ai and #07-27 Midview City, 18 Sin Ming Lane, Singapore 573960. Notices to the client may be sent to the account email. Neither party is responsible for delay caused by events beyond reasonable control. If a provision is unenforceable, the remaining provisions continue. No waiver is effective unless clear and written. Everest Nova may update these Terms prospectively; a material update is presented for acceptance before a later checkout.
